What is a trademark?

A trademark (popularly known as brand name) is an intellectual property which may be a name, device, label, numerals or combination of colours used to identify products or services from a particular source.

What is the purpose of a trademark?

The overall purpose of a trademark is to prevent unfair competition by protecting the use of symbol, word, logo, design etc that uniquely distinguishes goods and/or services of a company.

Can you explain the difference between a trademark, a patent, and a copyright?

A trademark often refers to a symbol, word, or words representing a person's or company's goods or services.

Patent registration refers to the process of securing a right to exclude others from making, using, or selling an invention. To qualify for a patent, the subject matter must (1) be considered new or novel, (2) have a useful purpose, and (3) be non-obvious to a person having ordinary skill in the art. Patents apply to new inventions and useful processes.

Copyright registration refers to the protection of creative works of expression, such as paintings, creative writings, sculptural works, performances, etc. Phrases, slogans, and taglines do not fall under copyright law.

How do I apply to register a trademark?

UK trademark applications must be filed at the UK Intellectual Property Office (‘UK IPO’) and EU trademark applications must be filed at the European Union Intellectual Property Office (‘EUIPO’). Applications can be made online or in paper form. How much does it cost to register a trademark?

An online UK trademark application (whether it is a name or a logo) is £170 which includes one class of goods or services. Any additional classes are charged at £50 per class.

An online EU application (whether it is a name or a logo) is €850 which includes one class of goods or services. A second class will cost €50 and three or more classes will cost €150.

What are classes?

Trademarks are categorised according to the products or services which they cover. There are 45 recognised trademark classes.

Does a trademark need to be renewed?

Yes, the trademark must be renewed after 10 years from the date of registration. It can be renewed for a further 10 years.
